IT-204 and IT-204-LL Combined Transmission

Drake Software has enabled e-filing the IT-204 and IT-204-LL in a single transmission in a 1065, partnership return. .

To transmit both returns together, you must select NY and NY LL in the State e-File Override on the EF screen:

Disregarded Entity

In Drake Tax, you can indicate that a NY IT-204-LL will be filed as a disregarded entity within the NY data entry. Click on the Other tab on the top right of the screen and select screen 204L. In Part 3 of this screen, you will see the indicator declaring that the entity is Filing Form IT-204-LL as a disregarded entity, as well as an entry point for the EIN or SSN of the entity or individual who will be reporting the income or loss.

The above only applies to Form NY IT-204-LL in a 1065 return. All NY IT-204-LL filers in the 1040 package are disregarded entities

Extension

An extension form for the NY IT-204-LL, Partnership, Limited Liability Company, and Limited Liability Partnership Filing Fee Payment Form, is not available in Drake Tax as NY does not allow for an extension of time to file or pay when filing Form 204-LL. Per the NY IT-204-LL Instructions:

"You must file Form IT-204-LL on or before the 15th day of the third month following the close of your tax year. Submit full remittance of any filing fee due with the form. There is no extension of time to file Form IT-204-LL or pay the annual fee. If the due date falls on a Saturday, Sunday, or legal holiday, Form IT-204-LL and the annual filing fee may be filed on the next business day. If you fail to timely file Form IT-204-LL, or fail to pay the full amount of the filing fee by the due date, you may be subject to penalties and interest."

Not producing

1065

If NY Form IT-204-LL is not producing in a 1065 return, first verify the entity type. The entity type for NY must be a regular partnership, limited liability company, or limited liability partnership to print the IT-204-LL. If no selection is made on Federal screen B, the return is considered to be a regular partnership. You can select Domestic LLC or Domestic limited liability partnership on Federal screen B to indicate the other return types.

Tip  If a different selection is correct for federal, but not for NY, you can override the Entity Type by going to NY screen 2.

Once you have ensured that the entity type is accurate, review the prior year income. Form IT-204-LL is not produced if the partnership’s prior year source income is less than $1,000,000. Review NYWK_LL to see if line 15 is greater than $1,000,000. You can enter amounts for NYWK_LL on NY screen 204L. If the source income requirement is not met, NY Note 96 generates reminding you to review NYWK_LL.

If NY Form IT-204-LL is not producing in a 1040 return, go to NY screen 204L and make a selection in the For box.
