Form 1023, Application for Recognition of Exemption Under Section 501(c)(3) of the Internal Revenue Code, is used to apply for recognition of exemption as an entity described in Section 501(c)(3). This form is not available in Drake Tax. Starting January 31, 2020, Form 1023 is required to be submitted electronically through www.pay.gov.

The electronic submission process replaces the paper submission process starting January 31, 2020.

Paper submissions of Form 1023 or 1023-EZ will no longer be accepted.

The paper Form 1023 may be accepted if the form is postmarked on or before the date that is 90 days after January 31.

Note If paper-filing, the postmark date is used to determine whether the return was timely filed. If the taxpayer is mailing their return, they may want to go to a Postal Service retail location and ask for a manual, or local, postmark. This will ensure that the date on the postmark is the same as the date of mailing. If the envelope containing the return is placed in a mail receptacle, it will still receive a postmark when it reaches a processing facility, but the postmark date may not be the same as the date that it was mailed. In short, if sending the return on or near the due date, request a manual postmark to ensure that the mailing will be considered timely by the IRS and state.
